Terms of Use

These Terms of Use govern your access to the website at optipulse.ai (the “Site”), operated by OptiPulse Inc.. By using the Site, you agree to these terms. If you do not agree, do not use the Site.

Informational purpose only

The Site is provided for general informational purposes. Nothing on it is an offer to sell, or a solicitation of an offer to buy, any product, service, or security, and nothing on it constitutes a recommendation to enter into any transaction. Products described on the Site are not yet commercially available, and descriptions of planned functionality are subject to change.

Nature of our business

OptiPulse provides trading software. We do not manage, direct, or take custody of customer accounts or funds. Customers retain full custody and control of their own brokerage accounts at all times, and we hold no login, password, API key, or other credential for any customer account.

The software is supplied to the customer as a file that the customer chooses whether to install and run on their own trading terminal. It operates on the customer’s own system, through the customer’s own broker, and the customer may disable or remove it at any time.

OptiPulse is not registered with the Commodity Futures Trading Commission and is not a member of the National Futures Association. We are not a commodity trading advisor, commodity pool operator, introducing broker, broker-dealer, or registered investment adviser, and we do not provide personalised trading advice or exercise discretion over any customer account.

No advice

Nothing on the Site is investment, financial, legal, tax, or accounting advice, and nothing on it takes into account your objectives, financial situation, or needs. You are solely responsible for your own trading and investment decisions and should consult your own qualified advisors.

Risk disclosure

Trading futures involves substantial risk of loss and is not suitable for everyone. You may lose more than you deposit. Past performance and simulated results are not indicative of future results.

Forward-looking statements

Statements on the Site about future availability, capabilities, or performance are forward-looking and reflect current expectations only. Actual results may differ materially, and we undertake no obligation to update them.

Early access requests

Joining the waitlist does not create a customer relationship or guarantee access. A request registers your interest only. Access is offered at our discretion, eligibility is verified before any customer relationship begins, and we may decline any request. Use of the software, when it becomes available, will be governed by a separate agreement that you will be asked to accept at that time.

United States only

The Site and our service are offered to persons in the United States only. We do not direct the Site or our service to any other country, we do not offer it in any other currency or language, and we do not accept customers who reside outside the United States. Eligibility is verified before any customer relationship begins, and applications from residents of other countries are declined.

We make no representation that the Site, or any product described on it, is appropriate or available for use in any other jurisdiction. Those who access the Site from elsewhere do so on their own initiative and are responsible for compliance with their local law.

Intellectual property

The Site and its contents — including text, graphics, logos, and the OptiPulse and QuantumEdge AI™ marks — are owned by OptiPulse Inc. or its licensors and are protected by intellectual property laws. You may view and print pages for your own non-commercial use. You may not otherwise copy, distribute, modify, or create derivative works from the Site without our written permission.

Acceptable use

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorised access to the Site or its systems
• Interfere with the Site’s operation or security
• Use automated means to scrape or harvest content, except for public search indexing

Our Privacy Policy explains how we handle personal information and forms part of these terms.

Third-party links

The Site may link to third-party sites. We do not control them, do not endorse them, and are not responsible for their content or practices.

Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, OptiPulse Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or trading losses, arising out of or relating to your use of the Site.

Indemnity

You agree to indemnify and hold OptiPulse Inc. harmless from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your misuse of the Site.

Governing law and venue

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or the Site will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of those courts.

Changes

We may revise these terms at any time. Changes take effect when posted, and the “Last updated” date above will reflect them. Continued use of the Site means you accept the revised terms.
